• The bill targets the very largest tech companies, those with at least $175 billion in annual revenue and platforms used by at least 34% of the U.S. population over age 12. These thresholds mean only a handful of companies like Amazon, Apple, Google, and Meta would be covered.
• Large platforms would be banned from favoring their own products over those of competing businesses in search results, rankings, or user interfaces, unless they apply neutral and nondiscriminatory standards to all business users equally.
• Tech giants would be prohibited from using private data collected from businesses on their platform to build competing products. They also could not block businesses from taking their own data to use on other platforms.
• Users would gain the right to change default settings and choose alternative apps or services on their devices. Platforms could not force users to buy or use additional products as a condition of accessing the platform.
• Violations could result in civil penalties of 1% to 10% of a company's total U.S. revenue. Repeat offenders could see their CEO and other top officers forced to give back up to a year's worth of pay.
• The FTC, DOJ, and state attorneys general would all have the power to enforce the law through civil lawsuits in federal court. Cases against covered platforms would get fast-tracked, with courts aiming to issue final judgments within one year.
