Key Points

• The bill lets DHS cancel removal and grant conditional legal status to undocumented people who arrived in the U.S. before age 18 and have lived here continuously for at least 4 years, if they pass background checks and have no serious criminal record.
• Qualifying individuals first get conditional permanent resident status valid for 8 years, during which they can legally live and work in the U.S., but this status can be terminated if they no longer meet eligibility rules.
• To convert conditional status into a full green card, applicants must complete at least 2 years of college, serve 2 years in the military, or work for at least 3 years, with exceptions for people with disabilities or full-time caregivers of minor children.
• The bill bars the government from using application information for immigration enforcement or referring applicants to ICE or CBP, except for fraud detection, national security concerns, or investigation of serious non-immigration felonies.
• Current DACA recipients get an expedited path to this new conditional status automatically, unless they have since engaged in conduct that would make them ineligible for DACA.
• Children enrolled in elementary, secondary, or early childhood education programs who meet the core requirements get an automatic stay of removal and cannot be placed in removal proceedings while enrolled.
