• The bill lets the U.S. Trade Representative investigate whether a company linked to a nonmarket economy country, like China, is shifting production to a third country just to dodge existing U.S. tariffs.
• If evasion is found, the government can charge the same tariff rate on goods made in the third country as it charges on the original nonmarket economy country's goods.
• The rules apply to companies where a nonmarket economy country or its firms hold at least 25 percent of the ownership stake, targeting state-linked businesses rather than small independent firms.
• Any new tariffs imposed under this bill stay in effect as long as the original tariffs remain active or as long as the foreign country keeps a controlling stake in the third-country operation, whichever ends first.
• If the Trade Representative decides not to act on a confirmed evasion case, they must explain the decision to Congress, including the economic effects of inaction.
