Freedom to Home Distill Act

Key Points

• This bill would allow people to make their own liquor, like whiskey or moonshine, at home for personal use. Right now, home distilling is illegal under federal law, even though making beer and wine at home is allowed.
• Homeowners could produce up to 10 gallons of spirits a year if they live alone. Households with two or more adults could make up to 20 gallons. None of this liquor can be sold or given away to anyone else.
• The plan removes federal taxes on home-made liquor and stops the government from requiring people to register their home stills. It also removes criminal punishments for making these small amounts of spirits at home.
• To keep people safe, any still sold for home use must have specific safety valves to prevent explosions. These home stills also cannot be larger than 50 gallons.
• If this becomes law, the new rules would start on January 1, 2027. This change would make the rules for liquor similar to the rules for home-brewed beer and homemade wine.
