This bill would add a Federal public defender to the United States Sentencing Commission. This is the government group that writes the rules and guidelines federal judges must follow when deciding how long someone should go to prison for federal crimes.
Right now, the commission has a nonvoting spot for the Department of Justice, which represents the side of the government that prosecutes crimes. This bill would give the side that defends people a seat at the table to ensure both perspectives are heard during meetings.
The new member would be a public defender or community defender chosen by the office that manages federal defense services. Although they would not be allowed to vote on final rules, they would participate in all discussions and provide expert advice on how sentencing laws affect defendants and their families.
